Fee clauses in contracts and notes can shift attorney’s fees to the debtor.

Deadlines depend on the contract and the facts. Have yours reviewed early.

Collection matters we handle

Five kinds of matters make up most of the firm’s collection work, all for businesses and investors owed $25,000 or more. If yours sits between categories, call anyway; most do.

Unpaid Invoices & Open Accounts

A customer took the goods or services and stopped paying. We pursue the balance, interest and, where the contract allows, attorney’s fees, from demand letter through judgment.

A borrower defaulted on a note, or a guarantor walked away from a personal guaranty. We enforce the note and the guaranty and pursue the collateral and the guarantor’s assets.

Promissory Notes & Guaranties

You won the case but have not been paid. We record judgment liens, garnish bank accounts under chapter 77, levy on non-exempt property and use proceedings supplementary under section 56.29 to reach assets held by others.

Judgment Enforcement

A judgment from another state or a federal court can be domesticated in Florida under section 55.501 and following, then enforced like a Florida judgment. Foreign country judgments follow a separate recognition process.

Out-of-State & Foreign Judgments

The debtor moved assets to a relative, a new company or an insider to avoid paying. Florida’s fraudulent transfer act, chapter 726, lets creditors unwind those transfers and pursue the recipients.

Fraudulent Transfers

Not sure where your situation fits? Tell us who owes you, how much and what you have in writing, and an attorney will tell you where it stands.
